Effective January 29, 2026 — These Terms of Service outline your rights and responsibilities when using Nocturnal Whispers.
By accessing or using Nocturnal Whispers you agree to this End User License Agreement. If you do not agree, do not install or use the application. You also confirm you are at least 18 years old and legally able to enter a binding agreement.
Nocturnal Whispers encourages honest expression, but we have zero tolerance for the following:
Any violation may result in immediate, permanent device-level bans without warning.
All reported content receives human review within 24 hours. You may Block or Report any post or user; blocking severs access so neither party can see the other’s whispers again. Our moderators may remove content, restrict features, or ban devices to protect community safety.
After Hours mode contains mature themes and is disabled by default. Only users who pass zero-knowledge proof age verification (18+) can opt in. Content tiles are blurred until you confirm you want to view them, and access may be restricted entirely in jurisdictions where mature content is prohibited.
You retain ownership of the whispers you create. By posting, you grant Nocturnal Whispers a limited license to host, display, and moderate that content. We may remove or restrict content to enforce the zero-tolerance rules above.
Nocturnal Whispers relies on approximate or precise location to surface nearby whispers. You control the accuracy level inside the app. Disabling location limits discovery and may disable certain features.
We reserve the right to suspend or terminate access at our discretion to protect the community. Moderation decisions can be automated, manual, or both. Appeals can be initiated via support@nocturnalwhispers.app.
Nocturnal Whispers has absolute zero tolerance for child sexual abuse material (CSAM) and child exploitation of any kind. All uploaded images are scanned by AI moderation before publication. Content flagged as potential CSAM is never published and is immediately quarantined. Confirmed or suspected CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline, as required by US federal law. Any device associated with CSAM is permanently banned with no possibility of appeal.

Content that encourages or provides instructions for self-harm is removed immediately. Content expressing personal distress is not automatically removed — we aim to connect users with help, not silence them.
Direct messages are end-to-end encrypted using the Signal Protocol. Our server stores only opaque encrypted blobs and has zero access to plaintext message content. Because we cannot read DMs, we rely on recipient-side reporting for DM moderation. If you receive abusive messages, use the in-app report button.
You retain ownership of the whispers you create. By posting, you grant Nocturnal Whispers a limited, non-exclusive license to host, display, and moderate that content. If you believe content infringes your copyright, submit a DMCA takedown notice to dmca@nocturnalwhispers.app. We will process valid requests within 10 business days.
We comply with valid legal process including subpoenas, court orders, and search warrants. In cases involving imminent danger to life, we may voluntarily disclose information to law enforcement without a court order. Law enforcement inquiries: legal@nocturnalwhispers.app.
Nocturnal Whispers is provided "as-is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for user-generated content, service interruptions, data loss, or any indirect, incidental, special, or consequential damages. Our total liability shall not exceed $100 USD. You use the App at your own risk.
You agree to indemnify and hold harmless Nocturnal Whispers, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the App, your content, or your violation of these terms.
Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Any unresolved dispute shall be resolved by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive any right to participate in a class action or representative proceeding. Either party may bring qualifying claims in small claims court.
These terms are governed by the laws of the State of Texas, United States. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in Texas.
We may update these terms to reflect new features or legal requirements. Material changes will be communicated via in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
